1Preamble & Binding Agreement

The Platform is owned, operated, and managed by Guyana Matrimony Inc., a company incorporated under the Companies Act, 2013, which operates the matrimonial platform under its trade name "Guyana Matrimony".

Any reference to "Guyana Matrimony", "Guyana Matrimony", "Platform", "we", "us" or "our" anywhere in these Terms shall be deemed to include Guyana Matrimony Inc., along with its directors, officers, employees, agents, vendors, service providers, affiliates, licensors, and assigns.

Welcome to Guyana Matrimony, an online matrimonial and matchmaking platform lawfully operated by Guyana Matrimony Inc. By accessing, registering, or using this website, mobile application, or any associated service (collectively referred to as the "Platform"), you ("User" or "Member") agree to be bound by these Terms & Conditions ("Agreement").

This Agreement constitutes an electronic record under the Information Technology Act, 2000 and its allied rules, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Personal Data Protection Act, 2023.

If you do not agree with any provision herein, you must refrain from using the Platform. Registration, login, or continued use constitutes irrevocable and full consent.

2Nature of Service (Intermediary Status)

  1. Guyana Matrimony operates solely as an intermediary under Section 2(w) of the Information Technology Act, 2000.
  2. The Platform provides a digital interface enabling users to connect for the lawful search of a bride or groom for matrimonial purposes.
  3. Guyana Matrimony does not guarantee marriage, compatibility, or the success of any connection or matrimonial outcome.
  4. The Platform bears no responsibility for user-generated content, communications, or any offline interactions between users.
  5. Guyana Matrimony's role is strictly limited to providing a secure, technology-based communication platform in compliance with Indian law.

3Eligibility

To access or use the Platform, you must meet all of the following conditions:

  • Be at least 18 years of age (female) or 21 years of age (male), as per applicable Indian marriage laws.
  • Be legally competent to marry under the law applicable to you.
  • Not be barred by any court order, injunction, or legal disability.
  • Use the Platform solely for personal and non-commercial matrimonial purposes.

4Mandatory Verified Badge Requirement

In order to ensure platform safety, authenticity, fraud prevention, and to eliminate fake profiles, harassment, impersonation, and misuse, the Platform has introduced a mandatory "Verified Badge", available at a nominal fee of ₹199/-.

Access to and continued use of the Platform's core matrimonial services is permitted only upon successful completion of the verification process and issuance of the Verified Badge. Users who do not complete verification shall have limited or no access to Platform services.

6Account Creation & Security

  • All information provided during registration must be accurate, current, and truthful.
  • Creation of multiple profiles by the same individual is strictly prohibited.
  • Users are solely responsible for maintaining the confidentiality of their login credentials.
  • Any unauthorised access, impersonation, or misuse may result in immediate suspension, termination, or legal action.
  • Guyana Matrimony shall not be liable for any misuse arising from shared credentials or user negligence.

7Content Ownership, Photos & Intellectual Property

  1. Users are solely responsible for all content, photographs, or materials uploaded on the Platform.
  2. By submitting content, the user grants Guyana Matrimony a non-exclusive, royalty-free, worldwide licence to store, display, process, and transmit such content for matchmaking and platform-related purposes.
  3. Users confirm that all uploaded content is authentic and legally owned by them.
  4. Guyana Matrimony reserves the right to watermark, moderate, or remove content that violates these Terms, applicable law, or decency norms.
  5. All platform software, code, layout, graphics, and data architecture remain the exclusive intellectual property of Guyana Matrimony Inc.

8User Conduct & Restricted Activities

Users agree not to engage in any of the following prohibited activities:

  • Uploading or distributing obscene, defamatory, misleading, or illegal content.
  • Misrepresenting identity, age, marital status, or profession.
  • Engaging in solicitation, financial fraud, or scam activities.
  • Uploading malware, spyware, or any harmful code.
  • Using the Platform for dating, casual relationships, or unlawful activities.
  • Harassing, threatening, exploiting, or abusing other members.
  • Collecting, sharing, or misusing other users' personal data.

Any violation may result in account termination, blacklisting, and reporting to relevant authorities.

9Payments & Premium Services

  • Premium memberships provide enhanced features and visibility.
  • All payments are final, non-transferable, and non-refundable, except where mandated by applicable law.
  • Subscriptions may be subject to automatic renewal unless cancelled prior to the renewal date.
  • Guyana Matrimony shall not be liable for errors attributable to banks, payment gateways, or third-party processors.
  • In the event of business discontinuity, no subscription fees or charges shall be refunded unless required by law.

10Communication & AI Match Disclaimer

  • Guyana Matrimony may use algorithms, filters, and AI-based tools to assist users in identifying potential matches; however, no results or compatibility outcomes are guaranteed.
  • Users acknowledge that all communications and decisions are personal, voluntary, and undertaken at their own discretion.
  • The Platform bears zero liability for any emotional, financial, or social consequences arising from user interactions.

11Privacy & Data Protection

  • Guyana Matrimony adheres to the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and other applicable data protection laws.
  • Collected data may include user details, preferences, usage analytics, and verified identification records.
  • Data sharing occurs only with lawful consent or as required by governmental or legal authorities.
  • Users may request correction or deletion of personal data, subject to statutory retention requirements.

12Safety, Security & Offline Conduct

  • Users are advised to follow the 'Be Safe Online' and 'Safe Guyana Matrimony' guidelines published on the Platform.
  • Guyana Matrimony is not responsible for any kind of offline meetings, communications, demand of dowry, or transactions between users.
  • Users must independently verify the authenticity of other users before any engagement.
  • The Platform shall cooperate with law enforcement agencies where legally required.

13Disclaimer of Warranties

The Platform and its services are provided on an 'as-is' and 'as-available' basis without warranties of any kind.

Guyana Matrimony disclaims all implied warranties, including fitness for a particular purpose, accuracy, reliability, availability, or matrimonial outcomes.

14Limitation of Liability

To the fullest extent permitted by law, the total liability of Guyana Matrimony and Guyana Matrimony Inc. in any shape/form i.e. claim, penalty, litigation, fees, claim against defamation or any other mode shall be ₹0 (Zero).

The Platform and its directors, officers, employees, and affiliates shall not be liable for any loss, injury, or claim arising from the use or non-use of the Platform.

Users bear full responsibility for all actions and communications on or off the Platform.

15Indemnity

Users agree to indemnify and hold harmless Guyana Matrimony and Guyana Matrimony Inc. from any claims, penalties, or legal expenses arising from breach of these Terms, misuse of the Platform, violation of law, or infringement of third-party rights.

16Force Majeure

Guyana Matrimony shall not be liable for any failure or delay resulting from events beyond its reasonable control, including natural disasters, governmental actions, cyberattacks, or communication failures.

17Termination

  • Guyana Matrimony may suspend or terminate any account at its sole discretion, without notice or refund.
  • Users may voluntarily delete their profiles; data deletion shall follow statutory retention requirements.
  • Termination shall not affect accrued rights or obligations.

18Arbitration & Dispute Resolution

All disputes shall be resolved exclusively through arbitration under the Arbitration and Conciliation Act, 1996, seated at the jurisdiction of the Company's registered office in Rajasthan, India.

19Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of India.

20Grievance Redressal

All grievances shall be addressed exclusively through the system-generated grievance mechanism. No telephonic or in-person grievance redressal shall be available.

21Amendments & Updates

Guyana Matrimony reserves the right to amend or update these Terms at any time. Continued use constitutes acceptance of the revised Terms.

22Entire Agreement & Severability

These Terms constitute the entire agreement between the user and the Platform. If any provision is held invalid, the remaining provisions shall continue in full force.
